EXEMPTION FROM SUBSECTION 5.2.5.3 of THE AERODROME STANDARDS AND RECOMMENDED PRACTICES (TP 312, 4th Edition) MADE PURSUANT TO SUBPARAGRAPHS 302.07(1)(a)(i) and (ii) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Canadian Aerodrome Operators, from the requirements of subsection 5.2.5.3 of The Aerodrome Standards and Recommended Practices (TP 312, 4th Edition) made pursuant to subparagraphs 302.07(1)(a)(i) and (ii) of Part III, Subpart 2 of the Canadian Aviation Regulations, subject to the conditions listed below.

Subsection 5.2.5.3 of The Aerodrome Standards and Recommended Practices stipulates that the aiming point marking shall commence no closer to the threshold than the distance indicated in the appropriate column of Table 5-1 attached hereto as Appendix “A”.

Purpose

The purpose of this exemption is to allow Canadian aerodrome operators to position the aiming point markings based on landing distance available rather than by runway code as shown in Table 5-1 of The Aerodrome Standards and Recommended Practices (TP312, 4th Edition), in accordance with the provisions of Annex14, Volume 1, subsection 5.2.5 of the Convention on International Civil Aviation, attached hereto as Appendix “B”, pending formal amendment of the Canadian standards.

Application

This exemption applies to all Canadian aerodrome operators in order to allow the positioning of the aiming point markings based on landing distance available rather than by runway code as presented in Table 5-1 of The Aerodrome Standards and Recommended Practices (TP312, 4th Edition), in accordance with the provisions of Annex 14, Volume I, of the Convention on International Civil Aviation.

Conditions

The exemption shall be subject to the following conditions:

  1. The aerodrome operator shall ensure that the aiming point marking shall commence no closer to the threshold than the distance indicated in the following table:

  1. The aerodrome operator shall ensure that a copy of this exemption is inserted in the Airport Operations Manual.
  2. The aerodrome operator shall ensure that the responsible aerodrome staff are advised of and trained regarding this change in marking.

Validity

This exemption is in effect until the earliest of the following:

  1. November 15th, 2017 at 23:49 Eastern Standard Time;
  2. the date on which any of the condition set out in this exemption is breached;
  3. the date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations and related standards comes into effect; or
  4. the date on which the exemption is cancelled by the Minister, in writing, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.

5.2.5.3 The aiming point marking shall commence no closer to the threshold than the distance indicated in the appropriate column of Table 5-1, except that, on a runway equipped with a visual approach slope indicator system, the beginning of the marking shall be coincident with the visual approach slope origin.
